JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-06-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 385 and other ancillary sections of the Indian Penal Code and section 17 of the Cr LA Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is no allegation in the FIR that the petitioner demanded ransom or threatened the informant. Petitioner's name has figured during course of investigation in confessional statement of co-accused Anil Sao who was arrested in some other case. petitioner is student of B.Sc. and on the date of occurrence he was appearing in the exam. No other substantive

In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Sherghati, Gaya in Gurua Police Station Case No. 167 of 2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
