This writ application has been filed seeking direction to the University Grants Commission to declare him qualified in University Grants Commission National Eligibility Test (NET) held in December, 2014, in accordance with the guidelines issued by the University Grants Commission, contained in Annexure 4. A counter affidavit has been filed on behalf of the respondent University Grants Commission stating specifically that the petitioner scored 40%, 42% and 56% in Paper I, II and III respectively. According to him, cut-off marks for clearing the NET held in December, 2014, was fixed is as 68% for Assistant Professor and 76% for JRF Assistant Professor. It appears from the pleadings in the writ application that this claim is based on minimum marks prescribed in the University Grants Commission

Patna High Court CWJC No.6041 of 2017 (3) dt.16-01-2018 2/2 guidelines. The same cannot be a basis for the petitioner to claim that he qualified in the test.

This application has no merit and is, accordingly, dismissed.
