The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34 and other ancillary sections of the Indian Penal Code.

Learned counsel for the petitioner submits that as a matter of fact petitioner never secured any loan nor the tractor in question belongs to him and it is one Lalita Devi wife of Amarjeet Mahto who is owner of the tractor. Though there is allegation of assault against the petitioner but no injury report is on the record. .

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender

Patna High Court CR. MISC. No.45624 of 2022(2) dt.06-12-2022 2/2 within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in Kalyanpur Police Station Case No. 83 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
