JUSTICE PARTHA SARTHY ORAL ORDER 16-03-2021 Heard learned senior counsel appearing for the petitioner and learned A.P.P. for the State. The petitioner has filed the instant application for grant of regular bail in connection with Bhore P.S. Case no. 214 of 2020 registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B) (a), 26 and 35 of the Arms Act. As per allegation in the F.I.R., on a raid being conducted four to six accused persons including the petitioner herein were caught and it is stated that the loaded country made revolver with a live cartridge and two live cartridges were recovered from possession of the petitioner.
It is submitted by learned senior counsel appearing for the petitioner that the allegation of recovery as made in the FIR
Patna High Court CR. MISC. No.40850 of 2020(4) dt.16-03-2021 2/2 are false and incorrect. The petitioner is in custody since 02.08.2020 i.e. for more than seven months.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the period in custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bhore P.S. Case no. 214 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Gopalganj.
