Mr. Ram Anurag Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-02-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Bhagwanpur Hat P. S. Case No.41 of 2020, instituted for the offences under Section 392 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 24.07.2021, charge-sheet has been submitted in this case and has antecedents of two cases and allegation is of looting the informant of his motorcycle, mobile, Rs.1500/-, leather jacket and gold ring by two unknown criminals.

The learned counsel for the petitioner submits that F.I.R. was against unknown and the petitioner came to be implicated in the present case based on the fact that he was using his own SIM in the looted mobile, which was also recovered from him. The learned counsel submits that petitioner

Patna High Court CR. MISC. No.55279 of 2021(2) dt.22-02-2022 2/2 had purchased the aforesaid mobile and as such, was not knowing that it was a stolen one, as such, he would not have used his own SIM in a looted mobile and thus, gets implicated. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and he was not put on T. I. Parade, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Siwan in connection with Bhagwanpur Hat P. S. Case No.41 of 2020, subject to condition that one of the bailors shall be the father of the petitioner namely, Rambabu Ray and in the event, if the petitioner is implicated in a case of similar nature, the learned Court below will forthwith cancel his bail bonds.

The application stands allowed.
