2. The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a)/32(2)/41(1) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 27 liters of Indian made foreign liquor was recovered from the seized vehicle.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of petitioner. His name transpired on the basis of confessional statement of the co-accused Dharmendra Kumar. Petitioner is neither driver nor owner of the seized vehicle. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts & circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise, Sheikhpura, in connection with Excise Case No. 17/2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
