The petitioner has filed the instant application for grant of regular bail in connection with Dinara P.S. Case no. 246 of 2020 registered under sections 467, 468, 471 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., on a raid being conducted by the police while the goods were being unloaded it is stated that three accused persons including the petitioner were arrested and a total 5397 litres of IMFL was recovered. It is submitted by learned counsel for the petitioner that from perusal of the F.I.R. itself it would transpire that the

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent and being in custody since 23.8.2020, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Dinara P.S. Case no. 246 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.- IInd -cum-Special Judge, Excise, Rohtas at Sasaram.
