This application is for grant of regular bail arises out of Wazirganj P.S. Case No.54 of 2014 registered for the offence under sections 363A, 365, 367 and 120-B of the Indian Penal Code.

The petitioner is said to have kidnapped the victim. He is in custody since 09.11.2024.

Learned counsel for the petitioner has drawn the attention of this Court to an order dated 18.08.2017 passed by a coordinate Bench of this Court in Criminal Miscellaneous No.21047 of 2017 (Annexure-2), by which co-accused was enlarged on bail.

Learned APP for the State has opposed the prayer of the petitioner for grant of bail and has submitted that the present petitioner is an absconder.

Considering the fact that co-accused has been granted bail by a coordinate Bench of this Court and also the period of custody of the petitioner, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st Gaya / concerned Court below, in connection with Wazirganj P.S. Case No.54 of 2014. 8.

This is also subject to the condition that the petitioner shall mark his attendance at Wazirganj Police Station, District- Gaya on first and third Sunday of each month. Any default in appearance at the police station would result in the cancellation of bail bonds of the petitioner. 9.

Since the petitioner is an absconder, his bail bonds shall be accepted by the court below after framing of charge. The petitioner shall cooperate in the trial and will appear himself or through his advocate on the dates fixed in the trial. (Sandeep Kumar, J) pawan/- U T
