JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Chakia P.S. Case No. 327 of 2018 for the offenses under Sections 395 and 397 of the Indian Penal Code.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. The petitioner is not named in the FIR. It is alleged that 25-30 persons entered into the house of the informant and took away ornaments and cash. The petitioner is in custody since 22.12.2018. Considering the fact that the petitioner has no criminal antecedent and he has not been named in the FIR nor put on TIP, the court is inclined to grant him bail. Let the petitioner, above named, be enlarged on bail on furnishing bail
