Petitioner is apprehending his arrest in connection with a case registered for the offences under Section 379/34 of the Penal Code and Sections 40, 49 of the BMMC Rules, 1972. He along with three others are named in the First Information Report. The other three have been admitted to the privilege of bail in the event of arrest by another Bench of this Court under order No. 2 dated 03.09.2015, passed in Cr. Misc. No. 35112 of 2015. Placing reliance to the said order two others have also been admitted to the same privilege under order No. 2 dated 30.09.2015, passed in Cr. Misc. Nos. 39366, 39380 both of 2015.

Let petitioner, named above, surrender in the

Patna High Court Cr.Misc. No.40191 of 2015 (2) dt.05-10-2015 2/2 court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and be granted the same treatment, as has been granted to co-accused Nos. 1, 3, 4 Lalan Singh, Chappu Singh, Ravi Singh under the aforesaid orders and petitioner is Accused No. 2 in the said case. This petition is, accordingly, disposed of.
