This is a petition for grant of anticipatory bail for offence under Sections 406, 420, 467 and 468 of the Indian Penal Code.
Allegation against the petitioner is that he took money from three electricity consumers to deposit the same. However, did not deposit the same with the electricity company, concerned, and handed over to them a forged receipt of deposit. Submission of the learned counsel for the petitioner is that the petitioner would make payment to all the named individuals in the first information report, under protest, before filing of the bail bond.
Considering the aforesaid proposal of refunding the respective amount through bank draft to be deposited in the Court below, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like
Patna High Court Cr.Misc. No.20856 of 2017 (3) dt.03-07-2017 2/2 amount each in connection with Muzaffarpur Town P.S. Case No. 784 of 2016 corresponding to G.R. No. 4841 of 2016 to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
