The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Rosera P.S. Case no. 261 of 2021 instituted for the offence under Sections 147, 148, 149, 447, 341, 323, 324, 307, 504, 506, 354B, 379 of the Indian Penal Code and later on section 302 added.
The prosecution story is that the petitioner and other co-accused persons came armed with deadly weapons at the door of the informant and started abusing him. When the informant forbade them, the accused persons started assaulting

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case on account of previous land dispute. It is further submitted that there is general and omnibus allegation leveled against the petitioner. It is further submitted vide para 8 of the petition that the specific allegation of is against co-accused Laki Singh, who assaulted upon the head of the deceased by means of spade. Similarly situated co-accused namely, Deepak Singh has already been granted anticipatory bail by a co-ordinate bench of this court vide order dated 18.08.2022 in Cr. Misc. No. 18075 of 2022. Learned APP appearing for the state has opposed the prayer of anticipatory bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Rosera P.S. Case no. 261 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees
