The petitioner apprehends his arrest in Sahebganj P.S. Case No. 176/2016, registered for the offences punishable under Sections 420, 409 of the Indian Penal Code. The gist of the allegation is that the petitioner being the Panchayat Secretary of gram panchayat Raj Bangara did not submit the merit list and roaster folder from the year 2003-2015 with regard to appointment of teacher.
It is submitted that the petitioner was made Incharge of Panchayat Secretary Madhopur Hazari in place of Binda Paswan due to ill-health of Binda Paswan, but Binda Paswan did not hand over the charge to him. Therefore, the petitioner was not
Patna High Court Cr.Misc. No.20256 of 2017 (3) dt.12-07-2017 2/2 in a position to hand over the folders and merit-list with regard to appointment of teachers.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, West Muzaffarpur in connection with Sahebganj P.S. Case No. 176/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
