The petitioner is seeking anticipatory bail in connection with Azam Nagar P.S. Case No. 31 of 2019 registered under Sections 341/323/324/307/379/504 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Katihar.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated because of some previous enmity between the parties which had arisen on account of some matrimonial dispute.

Learned A.P.P. for the State submits that there is specific allegation that this petitioner had assaulted the informant by giving a sickle blow and that has proved fatal as it

Considering the facts and circumstances of the case wherein the petitioner is said to have been armed with a sickle attacked the informant on her head and caused grievous injury, this court is not willing to extend the benefit of anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is refused. In case, petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered by the court below on it's own merit.
