JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-07-2017 The petitioners apprehend their arrest in a case under sections 302/34 of the IPC.

The informant stated his brother had gone to attend call of nature and when he returned he was in an injured condition. He revealed that the petitioners assaulted him. The injured died on way to Begusarai hospital.

Learned counsel for the petitioners submits that neither the informant nor any other witness has seen the occurrence.

Learned counsel for the State submits that the informant's brother named the petitioners as his assailants. Prayer for bail of the petitioners is rejected with

Patna High Court Cr.Misc. No.20397 of 2017 (3) dt.13-07-2017 2/2 direction to surrender and seek regular bail, which would be considered on its own merit, preferably the same day, without prejudice.
