2. The petitioners are apprehending their arrest in connection with Ara Nawada P.S. Case No. 290 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. On account of a dispute, owing to parking of the Motorcycle beside the road, the petitioners brutally assaulted the son of the informant by means of bricks and Iron rod, due to

Patna High Court CR. MISC. No.45068 of 2025(3) dt.17-11-2025 2/3 which he sustained serious injuries. It is also alleged that petitioner no.3 brought a pistol from his house and after putting it on the temple of the informant's son snatched valuables.

Learned Advocate for the petitioners submitted that the genesis of the occurrence is a dispute with regard to parking of the Motorcycle, due to which some scuffle took place, resulting into unfortunate injuries, however, the injuries, which are allegedly sustained to the son of the informant are found to be simple in nature. It is further contended that the petitioners are men of fair antecedent and they undertake that they will fully cooperate in the proceeding of the court.

5. On the other hand, learned APP for the State vehemently opposes the bail application and submits that the petitioners have actively participated in the crime and brutally assaulted the informant's son.

Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the genesis of the occurrence, coupled with the simple nature of injuries as well as fair antecedent, let the petitioners, named above, in the event of their arrest or surrender before the court below within four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds

No.45068 of 2025(3) dt.17-11-2025 3/3 of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 290 of 2025, subject to the condition as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close relative of the petitioners.
