The petitioners apprehend their arrest in connection with Khagaria (Chitragupta Nagar) P. S. Case No. 41 of 2017 instituted under Sections 323, 380, 420, 467, 468 and 471/34 of the Indian Penal Code.
The allegation, in brief, is that the informant purchased some land from one Gauri Devi. Later on, Gauri Devi and the informant (Manju Devi) together sold 05 dhurs land to Parvati Devi. In the meantime, Gauri Devi, in connivance with Halka Karmchari and other accused persons, fraudulently got Jamabandi created in her name with respect to the land purchased by the informant. It is also alleged that the hut made by the
Patna High Court Cr.Misc. No.20483 of 2017 (2) dt.12-06-2017 2/2 informant on the purchased land was dismantled by the accused persons and looted her household articles.
Learned counsel for the petitioners submits that whatever allegation is made out that is against Gauri Devi and not against these petitioners and they have been implicated merely because they are married daughters of Gauri Devi and they are living in their matrimonial house in different places and there is no specific allegation against these petitioners and also got no any criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioners, namely, Sita Devi, Rama Devi and Heeramani Devi, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S.Case No. 41 of 2017, G.R. No. 216 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Arun Kumar, J) Sujit/- U
