Mr.Shyam Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner is in custody since 09.05.2019 in connection with Bhabua P.S. Case No. 250 of 2019 for the alleged offences under Section 326-A of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated on the accusation of throwing acid on the informant from behind causing burn injuries on various parts of the body. It is submitted that there is no eye-witness to the occurrence and it is highly improbable that the informant would be returning from a restaurant at 11.15 P.M. It is submitted that the informant had earlier lodged a false case under Section 376 IPC in which however the petitioner was granted bail and for which reason she has again lodged the present FIR. The petitioner himself had filed Informatory Petition No. 252 of 2019 before the C.J.M., Bhabua as also Informatory Petition No. 17 of 2019 before the S.D.O., Bhabua which were filed prior to the present FIR.
Patna High Court CR. MISC. No.43007 of 2019(4) dt.20-11-2019 2/2 Except one prior case being Bhabua Mahila P.S.Case No. 69 of 2018 filed by the informant of the present case, the petitioner claims clean antecedents,.
4. Learned APP assisted by learned counsel for the informant opposes the bail petition, submitting on the basis of the case diary that the informant has suffered chemical burn injuries which support the accusation that the petitioner had thrown acid on her.
5. Having regard to the nature of accusations and gravity of the offence alleged, as well as the burn injuries sustained by the informant which prima facie appear to support the accusation, this Court is not inclined to grant privilege of bail to the petitioner. The bail petition stands dismissed.
6. The petitioner may renew his prayer for bail after framing of charge.
