The petitioner has filed the instant application for grant of regular bail in connection with Motipur P.S. Case no. 139 of 2019 registered under section 392 of the Indian Penal Code.

As per allegation in the first information report, it is stated by the informant that he is the Branch Manager of a finance company. He received information of three accused persons having come armed and of having looted Rs. 3,96,140/-.

It is submitted by learned counsel for the petitioner that the first information report was registered against three unknown persons. The name of the petitioner transpired in the alleged confessional statement of the petitioner himself and of

Patna High Court CR. MISC. No.40960 of 2020(3) dt.05-04-2021 2/2 one co-accused Ram Parikshan Sahni. However, no incriminating article has been recovered from his possession and he is in custody since 13.6.2019. He has not been put on T.I. parade and chargesheet has been submitted in the case. The prayer for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner specially chargesheet having been submitted and petitioner not having been put on T.I. parade, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Motipur P.S. Case no. 139 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (West), Muzaffarpur.
