2. The petitioner is in custody in connection with Kateya P.S Case No. 507 of 2024 PTN No. 5021 of 2024, Sessions Trial No. 229 of 2025 registered for the offences punishable under Sections 80, 85, 238 and 3(5) of the BNS, 2023.
3. As per allegation in the FIR, petitioner and her family members have assaulted the daughter of the informant due to non fulfillment of dowry. It is also alleged that petitioner and the other family members in connivance with each other had killed the informant's daughter and cremated her dead body
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.44296 of 2025(3) dt.03-09-2025 2/3 petitioner has falsely been implicated in this case. He submits that petitioner is the mother in law. He next submits that date of occurrence is 24.12.2024 and FIR has been lodged on 26.12.2024 that is, delay of about two days and for this there is no plausible explanation. He further submits that deceased has died due to electric short circuit and the husband of the deceased has informed the parents of the deceased and father of the deceased came and with his consent all the last rites and ritual has been performed. It is also submitted that petitioner is in judicial custody since 07.01.2025 having clean antecedent.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, case diary and the impugned order dated 27.05.2025, it appears that daughter of the informant was married to one Pawan Singh according to Hindu customs five years ago and after few days of marriage daughter of the informant was being tortured by her in-laws for the demand of dowry for which informant daughter used to complain to the informant. On 24.12.2021 in-law in connivance with other 5 to 7 unknown accused persons have committed murder of the informant's daughter by pressing her neck and in order to destroy the evidence, in-laws cremated the deceased body. It
Patna High Court CR. MISC. No.44296 of 2025(3) dt.03-09-2025 3/3 also appears from paragraph 3 and 4 of the case diary that all the witnesses has supported the case of the prosecution. In Paragraph 83 of the case diary shows that during the investigation, allegation against the petitioner has been found to be true, so considering the aforesaid fact and materials available on record, this Court is not inclined to enlarge the petitioner on bail.
7. Accordingly, the bail application of the petitioner is hereby rejected.
8. However, petitioner may renew the prayer for bail after six months from today if the progress of the trial does not seems satisfactory.
