The petitioner has preferred this application for grant of regular bail in a case registered under sections 393, 397 and 307 read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the informant alleges that while he along with his uncle was returning from a birth ceremony when they were intercepted by four criminals, who tried to commit robbery, but the informant tried to flee from the

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner has sprung up in the confessional statement of the co-accused. The other co-accused persons have already been granted bail by the Co-ordinate Bench vide order dated 09.05.2022 and 22.08.2022 passed in Criminal Misc. No. 67127 of 2021and 24324 of 2022 respectively. The petitioner is accused in one other criminal case as stated in para 3 of the bail petition. The petitioner is in custody since 19.07.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of detention, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Sahebpur Kamal P.S. Case No. 144 of 2021.
