1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Gopalpur P.S. Case no.131 of 2025, registered under sections 303(2) and 317(2) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that the mobile phone wherein he used the google map in his auto was stolen. In the CCTV footage, the accused who had taken away the mobile phone was identified as one Akash Kumar. On Akash Kumar being caught he disclosed that the stolen mobile had been sold to the petitioner herein. It is stated that the mobile was recovered from the possession of the petitioner.

4. Learned Senior counsel appearing for the petitioner

Patna High Court CR. MISC. No.43665 of 2025(3) dt.15-10-2025 2/2 submits that the petitioner who happens to be an owner of the electronics shop has been falsely implicated in the case. The allegations levelled in the FIR are false and concocted. The petitioner has no criminal antecedent and undertakes to cooperate in the case.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, at most the allegation against the petitioner being that of being in possession of stolen property and especially the petitioner not having any criminal antecedent, in the facts of the case, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Gopalpur P.S. Case no.131 of 2025, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna.
