2. The petitioner seeks bail in connection with Biraul P.S. Case No. 169 of 2023 registered for the offence under Sections 457, 382, 307 and Section 411/34 of the Indian Penal Code.

3. As per the prosecution case, four criminals had committed theft in the house of the informant and one of the thief was caught on the spot.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 29.05.2023, he is quite innocent and has not committed any offence.

5. Learned counsel for the petitioner further submits that the name of the petitioner has come on the

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the allegations levelled against the petitioner, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail after completing six months in custody and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Biraul/concerned Court below in connection with Biraul P.S. Case No. 169 of 2023 subject to the condition that:- (i) The petitioner will mark his attendance at the Biraul Police Station on first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
