The petitioner is in custody since 23.06.2020 in connection with Islampur P.S. Case No. 353/2020 registered for the offences punishable under Sections 376 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have established continuous cohabitation with the informant on the pretext of marriage for the last 3-4 years. It is submitted on behalf of the petitioner that petitioner has been falsely implicated in this case because the informant wants to marry him. It is further submitted that the medical report suggests her age to be 18-19 years and there is no

Patna High Court CR. MISC. No.40691 of 2020(2) dt.24-02-2021 2/2 sign of recent sexual intercourse. Petitioner has got no criminal antecedent and he is in custody since 23.06.2020. However, learned counsel appearing on behalf of the informant vehemently opposed the bail application and submitted that victim in her statement recorded under Section 164 Cr. P.C. has stated that the petitioner has been establishing physical relationship with her on the pretext of marriage from the last 3-4 years and, thereafter, refused to marry. Considering the aforesaid facts and circumstances and the gravity of allegation levelled against this petitioner and also statement of girl under Section 164 Cr. P.C., I am not inclined to grant bail to this petitioner.

It is, accordingly, rejected.
