The petitioner apprehends her arrest in connection with Kaler P.S. Case no. 21 of 2018, registered under Sections 406, 420, 468, 467, 471 and 120(B) of the Indian Penal Code. The accusation is that informant Gulshan Khatoon deposited Rs. 15,000/- in the Indusweir Industries, non-banking company situated at Charminar Market and she has also opened recurring account and deposited Rs. 200/- per month for about three years since 31st July, 2012. It is alleged that several persons have also deposited money in the said non-banking company, but, after maturity, the money was not returned to him. Later on, the name of the said non-banking company changed as Indus House. The persons named in the F.I.R. are
Patna High Court CR. MISC. No.43142 of 2019(4) dt.18-09-2019 2/2 agent in the said company.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, one Ashgari Khatoon claimed as account holder in the said company and she has stated that this petitioner was also active agent, who persuaded to the customers to deposit money in the said non-banking company. Further submission is that Saiyara Bano @ Saiyra Bano, who is also one of the agents of the said company, has already been allowed privilege of pre-arrest bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No. 4512 of 2019. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Arwal in connection with Kaler P.S. Case No. 21 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
