The petitioner seeks bail in connection with Sahar P. S. Case No.70 of 2019, instituted for the offences under Section 304-B/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that about six years back, her daughter was married to Dharmendra Rawani, but after marriage, the family members of the husband were demanding chain. Further, for non-fulfilment of the demand, the accused persons including

Patna High Court CR. MISC. No.56403 of 2021(2) dt.23-02-2022 2/2 the petitioner killed the deceased. It is next alleged that the deceased was even pregnant at the time of death. The learned counsel for the petitioner submits that the petitioner has been falsely implicated. She is sister-in-law of the deceased and even from perusal of the allegation as alleged in the F.I.R., it would manifest that the allegations are general and omnibus in nature. It is further submitted that husband is in custody.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Sahar P. S. Case No.70 of 2019.

The application stands allowed.
