The petitioners seek bail in connection with Mohiuddinnagar P. S. Case No.167 of 2020, instituted for the offences under Sections 302, 324, 323, 341, 447, 504, 506, 147, 148, 149 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are in custody since 05.07.2021, they are persons with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioners submits that the informant alleges that the accused persons armed with lathi,

No.55774 of 2021(2) dt.22-02-2022 2/3 danda, bhala and pistol entered the house of the informant and assaulted the family members leading to death of the father of the informant during course of the treatment. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the case and similarly situated co-accused Vishwanath Singh and Ranvijay Singh @ Ranvijay Kumar Singh have been granted bail by order dated 24.06.2021 in Cr. Misc. No.4790 of 2021.

The learned counsel further submits that petitioners and the informant are related and are agnates. It is further submitted that the post mortem does not disclose any external injury on the person of the deceased and the doctor has found the lever of the deceased ruptured and has given the cause of death due to trauma in his abdomen, shock and haemorrhage. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent, charge-sheet has been submitted in the case and co-accused have been granted bail, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the
