JUSTICE PARTHA SARTHY ORAL ORDER 06-04-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Bhagwanbazar P.S. Case no. 304 of 2020 registered under section 395 of the Indian Penal Code.

As per allegation in the FIR, a robbery was committed by the accused persons. It is further stated that FIR was registered against 5 unknown persons.

It is submitted by learned counsel for the petitioner that the name of the petitioner has transpired in course of investigation. The petitioner has been implicated on the basis of his confessional statement made before police which has not led to recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I. Parade, he is in custody since 7.9.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the period in custody and charge sheet having been submitted, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Bhagwanbazar P.S. Case no. 304 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Chapra, District Saran.
