1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 137(2), 140(3), 96, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Learned counsel for the petitioners submits that petitioner Nos. 1 and 3 are persons with clean antecedent and petitioner Nos. 2,4,5,6,7 and 8 have antecedent of one case and petitioner Nos. 2,6,7 and 8 are women and the informant alleges that on 02.03.2026 at 02:00 PM his minor grand daughter aged 15

No.44384 of 2026(2) dt.21-07-2026 2/3 years was kidnapped by ten named accused persons including the petitioners, further during search, Shubhash was apprehended with the help of villagers who disclosed that victim was in love with his brother-in-law Krishna, hence accused persons made her elope with him, further Shubhash was handed over to the police.

Learned counsel appearing on behalf of the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is next submitted that victim and Krishna were in love and they had eloped earlier for which Supaul PS Case No. 553 of 2025 came to be instituted in which petitioner Nos.

No.44384 of 2026(2) dt.21-07-2026 3/3 members of Krishna, it is also submitted that if privilege of anticipatory bail is granted the petitioners will not abscond rather will cooperate in the investigation to prove their innocence, it is also submitted that Krishna is not a petitioner in the instant anticipatory bail application.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Supaul P.S. Case No. 164 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.

7. This application stands allowed.
