JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 283, 120B, 341, 323, 353, 431, 504 of the Indian Penal Code. The prosecution case is that on 20.03.2015 some unknown miscreants committed theft in a shop situated in Raghopur market and while the informant being SHO, Raghopur P.S was investigating the case then accused persons put the burning tyre on the road and thereby paralyzed the traffic and obstructed the informant to perform his official duty. It is submitted by learned counsel for the petitioner that accusation is against the mob. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Patna High Court Cr.Misc. Case No. 45 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
