This is a petition for grant of anticipatory bail for offence under Section 47(a) of the Excise Act. In the year 2016 country made liquor was allegedly recovered from the house of the petitioner. The petitioner has stated on oath that he has got no criminal antecedent and the recovery was from the conscious possession of the petitioner.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Excise Case No. 41
Patna High Court Cr.Misc. No.20802 of 2017 (2) dt.12-05-2017 2/2 of 2006 to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
