ANJANA MISHRA ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner being the husband is in custody since 16.09.2018 in connection with Mansahi P.S. Case No. 101/2018 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the FIR itself is delayed and the family members of the deceased lady after having participated in the cremation has filed the present case as an after thought. He submits that the case is totally false and mischievous and the petitioner has been falsely implicated in connection with the same.

Having considered the entire facts and circumstances of the case and that even in the case diary, there is

Patna High Court CR. MISC. No.43386 of 2019(3) dt.30-09-2019 2/2 sufficient material to indicate that there was a demand for dowry preceding the death and that the marriage has taken place only one year back, I am not inclined to grant bail to the petitioner. It is, accordingly, rejected.
