The petitioner apprehends his arrest in Chandi P.S. Case No. 219/2012, registered for the offences punishable under Sections 20(II)(C)/22 of the NDPS Act.
The vehicle bearing registration no. OR 02BY 9700 was intercepted and two persons, namely Md. Rustam and Nisar Khan were apprehended. Lease documents were also recovered from the vehicle.
It is submitted that the name of the owner of the vehicle stands in the name of the petitioner, but the petitioner had given the vehicle on lease to ply the vehicle on road. The petitioner is not in conscious possession of the vehicle, but the police is running after the petitioner.
Patna High Court Cr.Misc. No.44194 of 2015 (3) dt.18-12-2015 Having had regards of the fact that the petitioner is the owner of the vehicle from which 100 kg of ganja was recovered, I am not inclined to enlarge the petitioner above named on anticipatory bail.
