Petitioner seeks bail in Special Case No.05-A of 2019 arising out of Thakurganj P.S. Case No.16 of 2019 instituted for the offence under Section(s) 22, 27, 29 of the NDPS Act. Counsel for the petitioner submits that the persons, who were apprehended at the spot, disclosed the name of the petitioner.

In the written report, it is alleged that police arrested Suman Kumar Sahu and Abhishek Banerjee and total 820 Miligram Smack kept in five puriyas were recovered. They disclosed the name of the petitioner and others, who ran away from the place of occurrence.

Patna High Court CR. MISC. No.42289 of 2019(2) dt.16-07-2019 2/2 accused, Suman Kumar Sahu and Abhishek Kumar, have already been granted regular bail by co-ordinate Bench of this Court by order dated 07.03.2019 passed in Cr. Misc. No.13420 of 2019.

Petitioner is in custody since 18.06.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge cum Special Judge, NDPS Act, Kishanganj, in connection with Special Case No.05-A of 2019 arising out of Thakurganj P.S. Case No.16 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
