====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 25-05-2021 Heard the parties in virtual Court proceeding. The petitioners are languishing in custody for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2018.

Recovery of liquor is alleged from a Van.

Submission is that the same is not of the petitioners and the petitioners are in custody since 18.08.2020. Investigation of the case is already complete. Petitioner no. 1 has got an identical criminal antecedent.

Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.3323 of 2021(3) dt.25-05-2021 2/2 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Koran Saray P.S. Case No. 76 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (c) The petitioners shall not leave the country without permission of the trial Court.

(d) With further condition that if the trial court would come to the notice that the petitioners are involved in commission of identical offence that would be a ground of cancellation of bail in this case also.
