JUSTICE SUDHIR SINGH ORAL ORDER 26-04-2017 This application has been filed for modification of the order dated 28.07.2015 passed in Cr.Misc.No.29505 of 2015. The petitioner was granted provisional anticipatory bail vide order dated 28.07.2015 passed in Cr.Misc.No.29505 of 2015 with a condition that the petitioner shall deposit 20% of Rs.31,98,999/- before the Bihar State Food and Civil Supplies Corporation within a period of ten months and thereafter the provisional anticipatory bail granted to the petitioner shall be confirmed by the court below itself.

It has been submitted that the amount in question has already been deposited before the competent authority of the Bihar State Food and Civil Supplies Corporation.

Patna High Court Cr.Misc. No.11823 of 2017 (2) dt.26-04-2017 2/2 Supplies Corporation admits that the said amount has already been deposited before the opposite party No.2 i.e. B.S.F.C. Considering the aforesaid facts and circumstances, the provisional anticipatory bail granted to the petitioner is hereby confirmed in connection with Durgawati P.S. case No.61 of 2015 pending in the court of Chief Judicial Magistrate, Kaimur at Bhabua.

The application stands disposed of.
