2. The petitioner seeks bail in case registered for offence under Sections 137(2) and 140(3) of the Bharatiya Nyaya Sanhita, 2023 .
3 . As per prosecution case , informant alleged that on 01.08.2024 , her 12 years old grand daughter had gone out to eat samosa but did not return . Informant suspects that this petitioner kidnapped her grand daughter.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case . Only suspicion has been raised against him. It is further

No.45591 of 2025(2) dt.22-08-2025 2/2 submitted that victim in her statement recorded under section 183 BNSS has denied the factum of kidnapping and stated that she was scolded by her grandfather and mother due to which she left her house out of her own volition and no one kidnapped her. Petitioner is in custody since 20.04.2025 . Chargesheet has already been submitted.
5 . Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts, statement of the victim under section 183 BNSS period of custody and circumstances of the case , let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional district and sessions Judge - VIth Nawada in connection with Nawada P.S. Case No. 892 of 2024 .
