Learned counsel for the petitioner undertakes to remove the defect(s), as pointed out by the office, within four weeks.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419, 420, 406, 467, 468, 120B and 34 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner has been falsely implicated in this case. Petitioner was running a construction business and he was Managing Director of the same. Petitioner was running the business very successfully and due to that this informant agreed to invest money and a number of time he got benefit for the same. Learned counsel for the petitioner further submitted that the petitioner has criminal antecedent as mentioned in para-3 of the bail application.

No.46088 of 2022(7) dt.24-01-2023 2/2 Learned counsel for the petitioner submits that petitioner is ready to refund Rs. 32,00,000.00 (Rupees Thirty Two Lakhs) to the opposite party no. 2/informant within six months. Out of Rs. 32,00,000/- (Rupees Thirty Two Lakhs) he will pay Rs.5,00,000.00 (Rupees Five Lakhs) at the time of furnishing of bail bonds and rest amount will be paid from March, 2023 in equal installments.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on provisional bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Laheriasarai P.S. Case No. 425 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

Learned Court below is directed to confirm the bail bond of the petitioner after refunding the aforesaid amount to the informant.
