The petitioners seek anticipatory bail in Udwant Nagar P.S. Case No.397 of 2016 instituted for the offences under Sections 147, 148, 149, 448, 435, 504, 506 of the Indian Penal Code, Section 4, 4 and 5 of the Explosive Substance Act and Section 27 of the Arms Act.
Allegation has been made to have raided the house and started indiscriminate firing, used explosive substance. It has further been alleged that they sprinkled the petrol and lit fire in the cattle house.
In such view of the matter, this Court is not inclined to enlarge the petitioners on anticipatory bail. Accordingly the
Patna High Court Cr.Misc. No.20926 of 2017 (3) dt.07-07-2017 prayer for bail is rejected. However, if the petitioners surrender before the court below within a period of three weeks, the court below will pass an order on the same day on its own merit without being prejudiced by the order passed by this Court.
