Petitioner apprehends arrest in registered for the offences punishable under Section 406 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act. It is a case of cheque bounce. Petitioner is author of the cheque in question.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He next submits that the cheque in question was issued by the petitioner only for the purpose of security. Learned counsel for the informant vehemently

Patna High Court CR. MISC. No.46414 of 2022(4) dt.27-03-2023 2/2 opposes the prayer for bail application and submits that the cheque issued by the petitioner bounced due to insufficiency of funds.

Considering the aforesaid facts, prayer for bail of the petitioner is refused.
