JUSTICE ANIL KUMAR SINHA ORAL ORDER 05-03-2021 Heard Mr. Niranjan Parihar, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Desari (Sahdei O.P.) P.S. Case No. 343 of 2019 registered for the offence punishable under Section 392 of the Indian Penal Code 1860.
The allegation as per the First Information Report is that the informant after collecting the amount of H.B.D. Finance was coming back, he was intercepted by four Motorcycle borne criminals who snatched a sum of Rs.24,600/- and a bag containing Driving license, Pan Card, Aadhar Card and Finance Identity Card from the informant.

No.631 of 2021(2) dt.05-03-2021 2/3 Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and his name has transpired on the basis of confessional statement of co-accused Dipak Paswan. Learned counsel further submits that the petitioner has been remanded in this case from Desari P.S. Case No. 16 of 2020 in which he has been granted bail by a coordinate Bench of this Court. Learned counsel also submits that the petitioner is in custody since 8.3.2020. Learned counsel next submits that no incriminating article and/or looted articles has been recovered from possession of the petitioner and the petitioner was not put on Test Identification Parade. Having regard to the submissions made by the parties and taking into consideration the nature of allegation and the material on record, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XVth, Vaishali at Hajipur, in connection with Desari (Sahdei O.P.) P.S. Case No. 343 of 2019 subject to the condition that the petitioner will be well represented on each

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
