ANJANA MISHRA ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.04.2019 in connection with Sandesh P.S. Case No. 29 of 2019 registered for the offence under Sections 394 and 307 of the Indian Penal Code and Section 27 of Arms Act.

Learned counsel for the petitioner submits that on the basis of the confessional statement made before the police by one Nagesh Yadav, petitioner has been taken into custody. It is further submitted that there is nothing against the petitioner save and except confessional statement which has no evidentiary value.

Considering the aforementioned facts and circumstances and the similarly situated co-accused, Nagesh

Patna High Court CR. MISC. No.43813 of 2019(3) dt.30-09-2019 2/2 Yadav has been extended privilege of bail in Cr. Misc. No. 52127 of 2019 vide order dated 26.08.2019 and the petitioner having one other criminal incident in which he has already been granted bail, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Judicial Magistrate, Bojpur at Ara in connection with Sandesh P.S. Case No. 29 of 2019.
