JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-11-2015 Heard learned counsels for the petitioners and the State. The petitioners being son-in-law and daughter-in-law of the brother of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant within three years of marriage for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioners that the petitioners are separate from the husband of the victim and husband of the victim Upendra Singh and Babita Devi, wife of the brother of the husband of the victim have been acquitted vide S.T.

Patna High Court Cr.Misc. No.45318 of 2015 (2) dt.04-11-2015 2/2 No. 879 of 2008.

Since the impugned order reflects that the petitioners were declared absconders, this court is not inclined to grant anticipatory bail to the petitioners. However, let the learned court below consider the prayer for regular bail of the petitioners keeping in view the fact that co accused have been acquitted in case the petitioners surrender within six weeks from today in connection with Paroo P.S. Case No. 58 of 2008 (S.T. No. 879 of 2008) pending in the court of learned F.T.C. V, Muzaffarpur. This application is disposed of with the aforesaid observation/direction.
