JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2019 Petitioner seeks bail in anticipation of her arrest in connection with Kotwali P.S. Case No. 97 of 2015 registered for the offences punishable under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

As per FIR there is allegation against Md. Shamshad, including petitioner and others that they were engaged in providing Visa and for that they have taken money from the informant and others but they have not provided Visa to the informant and others and Md. Shamshad is found to be traceless and his mobile was switched off.

Submission of learned counsel for the petitioner is that she has been made accused only because she is wife of Md. Shamshad and allegation is Md. Shamshad and she is ready to abide by any condition that may be imposed on her.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger, in connection with Kotwali P.S. Case No. 97 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that she has to co-operate in the investigation and appear before the police as and when required.
