Petitioners apprehend their arrest in connection with Belchhi P.S. Case No. 37 of 2016 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code. Khushboo Devi, the daughter of the informant, was married to Kundan Ram, the son of the petitioners, and he started demanding Rs. 50,000/- and for that he used to assault and torture her and ultimately, Khushboo Devi was killed and it is alleged that the petitioners and other have killed her.
Submission is of false implication and that the petitioners are mother-in-law and father-in-law, there is no specific allegation against them, the specific allegation is against husband for demanding money, co-accused Chandan Kumar has
Patna High Court Cr.Misc. No.22181 of 2017 (3) dt.01-07-2017 already been allowed pre-arrest bail vide Cr. Misc. No.17168 of 2017 by another co-ordinate Bench of this Court and as such they deserve sympathetic consideration.
Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering that the petitioners are mother-in-law and father-in-law and there is no specific allegation against them, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Barh, Patna in connection with Belchi P.S. Case No. 37 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
