The petitioner is apprehending his arrest in connection with Nawada Town P.S.Case No.633 of 2016 (G.R.No.2995/2016) registered for offences punishable under Sections 147, 447, 341, 323, 307, 379/34 of the Indian Penal Code.
Allegation against the petitioner is of assault by Khanti on the head of the informant causing injury.
Submission of the learned counsel for the petitioner is that the petitioner is a government servant and he is ready to abide by any condition imposed upon him and even the opinion on the injury has been kept reserved and the dispute is with respect to lane. Both the parties are neighbour.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.13868 of 2018 (3) dt.27-06-2018 2/2 bail stating that the petitioner was earlier convicted also in a case and he has criminal antecedent.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on the basis of merit of the case and will try to dispose of the same on the same day.
