JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused, Dharmendra, are alleged to have assaulted son of the informant with spade causing two injuries on his person. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that there is case and counter case in which both sides sustained injuries, including this petitioner, who has received grievous injuries. Both sides are agnates and on account of land dispute the occurrence has taken place. Petitioner claims clean antecedent and is in custody since

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Jhanjharpur, Madhubani in connection with Laukaha (Lalmaniya) PS case No. 159/2021.
