The petitioner who is in custody since 21.04.2019 has filed the instant application for grant of bail in connection with Khodawandpur (Chhaurahi) P.S. Case No. 220 of 2018 (District Begusarai) registered for the offence punishable under section 395 of the Indian Penal Code.

As per the allegation in the FIR, the five accused persons, on the point of pistol looted the informant's bag containing Rs. 1,30,000/- in cash belonging to his mother. The FIR was registered against five unknown persons. The name of the petitioner transpired in course of investigation. It is submitted by learned counsel for the petitioner that in spite of petitioner being in custody since 21.04.2019 he

Patna High Court CR. MISC. No.44251 of 2019(3) dt.16-10-2019 2/2 has not been put on T.I. Parade and charge sheet has been submitted in the case. It is submitted that the case of the petitioner stands on similar footing to the co-accused who has been granted bail by order dated 15.03.2019 passed in 16216 of 2019.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration that the petitioner is in custody since 21.04.2019, his not being put on T.I. Parade and the investigation having concluded with submission of charge sheet, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Manjhaul, Begusari in connection with Khodawandpur (Chhaurahi) P.S. Case No. 220 of 2018 (District Begusari).
