JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-07-2017 Heard learned counsel for the petitioners and learned APP representing the State.
The petitioners apprehend their arrest in connection with Kotwali (Adampur) P.S. Case No. 479 of 2016 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
Allegedly, the petitioners being Panchayat Secretary of Telghi and Dhuawe Gram Panchayat respectively did not submit Folders relating to appointment of teachers.
Submission is of false implication and that the petitioners took charge in the year 2016 whereas the occurrence has taken place in the year 2003-05 and 2006, the petitioners have got no concern, they are law abiding persons, they have got no
Patna High Court Cr.Misc. No.24972 of 2017 (2) dt.14-07-2017 criminal antecedent and in this case several co-accused have been allowed pre-arrest bail.
Learned APP fairly submits that other co-accused similarly situated have been allowed pre-arrest bail. In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No. 479 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
