2. Petitioner seeks bail who is in custody since 13.05.2026 in connection with Kasar P.S. Case No. 52 of 2026, F.I.R. dated 07.05.2026 for the offences punishable under Sections 137(2) and 140(3)of the BNS, 2023.

3. According to prosecution case, this petitioner along with other accused persons abducted the informant's 5 year old child and killed him due to non-fulfillment of demand of ransom amount asked by the accused persons.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the

Patna High Court CR. MISC. No.44061 of 2026(2) dt.07-07-2026 2/3 FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. Initially the petitioner was not named in the FIR and his name has been transpired on the basis of the confessional statement of the co-accused namely, Santosh Kumar Ravidas. Except the aforesaid, nothing has come during investigation which suggest the involvement of the petitioner in the present occurrence.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that the co-accused Santosh Kumar Ravidas was arrested by the police on 12.05.2026 and his confessional statement was recorded in which he has stated that the petitioner has also participated in the present crime in question. He further submits that the petitioner along with other accused persons took the child to Sumbha Hill located outside Nawadih village in Nawada district and co-accused Sudam Manjhi took silver locket of the child and informed the petitioner and other accused person that the father of the child namely, Kanhaiya Kumar Pandit refused to pay ransom of Rs. 50 lakhs, so he decided to kill Kanhaiya Kumar's child and to dispose of the dead body. Thereafter, all the accused persons murdered the child by covering him with shawl and strangling him. He further submits

No.44061 of 2026(2) dt.07-07-2026 3/3 that after 10 days of the said incident, on 16.05.2023 the mutilated skeletal remains of the abducted child, Deepanshu Kumar were recovered and his skeletal remains were sent to PMCH for examination. He further submits that it appears from the aforesaid that the petitioner has actively participated in the present crime in question along with other accused persons. As such the allegation of abducting and murdering the 5 year old child of the informant was found to be true against the petitioner and other accused persons.

6. Considering the aforesaid facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Kasar P.S. Case No. 52 of 2026 pending in the court of learned Judicial Magistrate-1st Class, Sheikhpura.
